As air transport is being re-established, we need to understand that air travel will not be exactly the same as it was before the Covid-19. Extra time, more patience, medical procedures, and different behavior onboard are just some of the novelties awaiting us in the time of the pandemic.

Airports in the Republic of Serbia accommodate flights for 28 airlines. Since the pandemic outbreak, the Civil Aviation Directorate has been closely and continuously supervising air carriers' operation.

Air travelers should check for any additional requirements before arrival at their destinations to avoid inconveniences because the procedures change daily. Detailed information ensuring safe air travel for passengers are on the links below.

Passenger rights in Serbia are regulated Law on Obligations and Basis of Property Relations in Air Transport incorporating appropriately transposed parts of the E.U. Regulation E.C. No 261/2004 laying down common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights. 

As the situation caused by the COVID-19 virus pandemic affected all industry without exception, the European Commission published the document "Interpretative Guidelines on E.U. passenger rights regulations in the context of the developing situation with Covid-19" Brussels 18/3/2020 C (2020) 1830 final, where it is stated:

"Regulation 261/2004 provides for compensation in a fixed amount in some circumstances. This does not apply to cancellations made more than 14 days in advance or if the cancellation is caused by 'extraordinary circumstances' that could not have been avoided even if all reasonable measures had been taken. See Article 5 (1) and Article 7 of the Regulation for details.

The Commission considers that, when public authorities take measures aimed at curbing the COVID-19 pandemic, such measures are by their nature and origin inconsistent with the normal conduct of the carrier and are beyond their actual control.

Article 5 (3) waives the right to compensation provided that the disputed cancellation is "caused" by extraordinary circumstances, which could not have been avoided even if all reasonable measures had been taken.

This condition would also be considered fulfilled when the cancellation of the flight is caused by a decision of the competent authorities prohibiting certain flights or prohibiting the movement of persons in a manner that excludes, de facto, travel on the flight in question.

This condition may also be met if the cancellation occurs in circumstances where the movement of persons is not completely prohibited but is limited to persons subject to derogations (for example, nationals or residents of the country concerned) "- Decision to declare COVID-19 SARS -CoV-2 infectious disease.


 

 

FAQ regarding the COVID-19 situation:

  • Tickets to Athens purchased. The carrier operates the flight even though Serbian citizens are forbidden to enter Greece.

Answer: The flight is deemed to have taken place. The air carrier has no responsibility for the restrictions imposed on the residents of another state. Passengers have the right to compensation, while a refund is possible according to the rate at which the ticket was purchased.

  • The air carrier canceled my flight three days before the scheduled departure. The reason is the ban on landing aircraft in the country - the destination. Am I entitled to compensation?

Answer: The law stipulates that air carriers may cancel any flight without the obligation to refund if passengers are notified of the cancellation at least two weeks before the departure scheduled or at a later date if it is proved that the flight was canceled due to unavoidable extraordinary circumstances. Please, take all reasonable measures. COVID-19 is considered an emergency, and therefore passengers will not receive a refund.

  • The air carrier canceled my flight, and offered me a voucher instead of money. What are my options?

Answer: At the proposal of the Ministry of Construction, Transport, and Infrastructure

The Government of the Republic of Serbia adopted Decision No 343-3718 / 2020-1 of 08/05/2020 recommending air carriers, holding the operating license under the law governing air transport, to issue vouchers to passengers for canceled flights due to extraordinary circumstances caused by the disease COVID-19. These vouchers enable passengers to exercise their rights by choosing between:

   -changes in the date of travel, according to similar transport conditions, to the final destination as acceptable to the passenger, depending on the availability of free seats;

    -the opportunity to use the amount corresponding to the full price of the ticket at which it was purchased on one of the flights in the airline's network at a later date as is acceptable to the passenger, depending on the available seats.

The voucher above may be used by December 31, 2021. 

If passengers do not opt for a voucher, the air carrier must refund passengers. In order to receive a refund, passengers should submit a complaint, processing of which can take up to several months due to the current circumstances in the overall aviation industry. 

  • Are there any specific travel restrictions regarding the situation caused by the Coronavirus?

Answer: The situation regarding the free movement of passengers, and the air transport operations changes from day to day, and restrictions are more or less in force in all countries.   • I paid RSD 10.000 dinars for the ticket; I can't travel because I was forbidden to enter the destination country. This flight deemed to have taken place. The air carrier refunded me only RSD 3.000. Am I entitled to a full refund?

Answer: The amount of the refund depends on the rate at which the ticket was purchased. When booking tickets, the passenger chooses one of the offered rates (BASIC, FLEX, LIGHT, G.O., BUSINESS, PLUS, etc.). At the time of payment, the passenger confirms that he/she agrees with the conditions of the purchase.

Therefore, passengers are encouraged to buy fares that allow them to fully reimburse costs or at least allow for a change in departure/return dates in a situation where the free movement of passengers is disrupted.

At the proposal of the Ministry of Construction, Transport and Infrastructure

The Government of the Republic of Serbia has adopted a regulation 343-3718 / 2020-1 of 08.05.2020 recommending the air carriers, having been issued the operating license under the law governing air transport, due to cancellation of flights in emergency situation caused by COVID-19 to issue vouchers to passengers enabling them to exercise their rights by choosing between:
  •  changing the date of their travel, under the similar conditions of transport, to the final destination as acceptable to the passenger, depending on the availability of free seats;
  •  the possibility to use the amount corresponding to the full price of the ticket at which it was purchased on one of the flights on the air carriers network at a later date, as acceptable to the passenger, depending on the availability of free seats.
The voucher referred to in paragraph 1 of this Article may be used until December 31, 2021.

Under the Decision on Declaring Emergency Situation ( Official Gazette of the Republic of Serbia Nos 31 / 2020, 36/2020, 38/2020, 39/2020) and the Regulation on Emergency Measures (Official Gazette of the Republic of Serbia Nos 31/2020, 36/2020, 38/2020, 39/2020) the Government of the Republic of Serbia suspended air operations in the Republic of Serbia for all commercial flights.

As the situation caused by the COVID-19 virus pandemic affected all air carriers without exception, the European Commission published a document titled  “Interpretative Guidelines on EU passenger rights regulations in the context of the ongoing situation regarding COVID-19”, Brussels 18/3/2020 C (2020 ) 1830 final, which states, among other things:

where public authorities take measures intended to contain the COVID-19 pandemic, such measures are by their nature and origin not inherent in the normal exercise of the activity of carriers and are outside their actual control respectively "is caused" by extraordinary circumstances, which could not have been avoided even if all reasonable measures had been taken.

Accordingly, passengers' compensation claims will be treated in accordance with the circumstances of the emergency, which relieves the carrier of the obligation to pay the passengers damages.
